Dourada’s General Conditions:

These General Purchase Conditions are based on the legal regulations in force in Spain in the process of buying and selling DOURADA products, through the website, www.dourada.es.

These conditions establish a link between the seller and the buyer, clarifying and applying the rights and obligations of both parties. An email will be sent to the customer once the order placed at the Dourada’s website is confirmed by the same company. The contents of the clauses are only for informational purposes and do not give scope for the interpretation of the General Conditions.

DOURADA provides all the necessary information to the client through this document.

CLIENT

Any natural or legal person who places an order through the website www.dourada.es

is considered a customer. The relations between the selling company and the client will be established in accordance with the current Spanish regulations regarding consumers and users.

The client must provide the appropriate data in order to place the order.

In accordance with Organic Law 15/1999, of December 13th, on the Protection of Personal Data, and with the Law 34/2002, of July 11th, on Services of the Information Society and Electronic Commerce, DOURADA, will store the data provided by the Client. Said data, the personal information and details will only be used for the operation in question, and will not be transmitted to third parties. DOURADA may send commercial information about its products, leaving the customer the right to cancel these communications at any time by email art@dourada.es.

The purpose of this contract is the online sale and purchase of products offered by DOURADA, such as: original illustrations (all rights reserved to DOURADA), fine art - certified reproductions, posters, Foamcoreposter, Puzzles and Post Cards; Fashion products as: clothing, bags, Kimonos, night-suit, neckerchiefs; Boards as surfboard and skateboard; and other customized items, as art walls, pillows, vehicle’s plotter.

PRODUCTS AND PRICES

The DOURADA offer is limited to the products that are available on the website as well as the availability of sizes, colors and models.

Each product has a file that indicates the name of the product, the size, material model or design, an approximate photograph and the retail price of the product, always with VAT INCLUDED.

Shipping and insurance costs and additional costs of the payment method (expenses and commissions produced by Paypal) are not included in the price.

The total cost of the order will be communicated to the Customer at the time of placing their order and prior to acceptance.

ORDER CONFIRMATION

The offer will be considered accepted by the Client at the moment he clicks on the "PAY" button. The Client will receive an email confirming the order and its specifications.

PAYMENTS

All payments will be made through the PayPal platform or credit card device. DOURADA will not be responsible for the commissions and fees of any payment platform. In the event that the Client may wish to pay by bank transfer, they must contact by email art@dourada.es.

The shipping costs of the order will depend on the delivery area and the cost of the same will be communicated before the acceptance of the order by the Customer and must be paid by the Customer.

Once the purchase is made, you will receive a confirmation message from PayPal or your baking account with the order information. Within up to 24 hours, the Customer will receive an email from DOURADA confirming the order and the shipping address.

The Client must read and accept the General Conditions before confirming the order.

PRODUCT DESCRIPTION

The description and information about each product, as well as the photographs are exposed in DOURADA website for guidance. For any questions regarding the material used, clothing details, color tones and sizes, or even for any customized products, the Client may consult us through the email art@dourada.es, or through the company's social networks.

DELIVERIES AND SHIPPING

Shipments of orders made through the web www.dourada.es, will be made by Post, as a registered package. In the event that the Client wants another type of shipment, such as urgent, by courier or in person, they must contact us by email and assume the costs related to that specific cost of a special delivery. The delivery time will vary according to the client's geographical position.

For shipments to Spain Peninsula the delivery time is between 5 and 7 business days. For shipments to the Balearic Islands and International shipments within the European Union, the delivery time is between 7 and 10 business days. In general, for areas outside the European Union, the delivery time could take 1 to 2 weeks. Equally, in case is there any urgent purchase, as a gift with a specific delivery time, the Client must ask us for a special freight and service and we will attend it accordingly with customer’s needs.

In case any product is not available in stock, the company will inform the Customer of the delivery times. Saturdays, Sundays, public holidays in the locality of DOURADA’S registered office, as well as holiday periods, Christmas period and unexpected political or natural situations are excluded.

The delivery times indicated are indicative depending on the shipping area and may be altered by extraordinary incidents. DOURADA is not responsible for delays due to causes beyond the control of the company and for unforeseeable and unavoidable circumstances. Neither is it responsible for delays attributable to the carrier or customs clearance.

If after the established delivery time of the order, the delivery has not been arranged, the Client must contact DOURADA. In the event that the Client does not do so, after 10 working days from the delivery of the order, it will be returned and the Client must take charge of the shipping and return costs of the merchandise, as well as any possible expenses. associated management.

COST OF SHIPPING COSTS

The standard shipping service of DOURADA will be made through the Spanish post office service, by registered package. The follow prices correspond to the shipment of up to 2 pieces, about 300 grams. For Spain Peninsula the cost is around 5€ with VAT included, for the Balearic Islands and other countries of the European Union the cost are around 7€ to 10€ with VAT included and for countries outside the European Union the costs are around 12€ to 15€ (or more, depending on the location) with VAT included.

DOURADA will not take charge of the customs expenses of the country of destination of the delivery order.

RETURNS & EXCHANGES

All the products that leave our warehouses are previously verified. In the event that the product reaches the customer it arrives defective, with a different size or color than the order, or manipulated by third parties, the Customer must contact us by email www.dourada.es within a maximum period of 24 hours from receipt and company will detect the problem.

If for any reason, the client is not satisfied with the purchased product, he can return it within 14 calendar days (right of withdrawal according to Law 3/2014, of March 27), from the date of receipt of the product in the delivery order final destination.

In the case of returning the product, the customer must send an email to art@dourada.es specifying the reason for the return. Within 24 hours, the customer will receive an email with the return details and information data as well as the shipping address. In case of the exchange or refund, after the 14 calendar days that the law imposes, DOURADA will do its best to solve the issue with the aim of satisfying the client, although, in this case, the same must take charge of the shipping costs and taxes involved in said return and the changes will depend on the availability of the products in our stock.

The return conditions that imply the reimbursement of the total amount of the items purchased will be made in accordance with the Law in force in Spain since the products are not used, washed or damaged, which are returned in their original packaging. Only changes in size or color clothing are allowed depending on stock availability. If the client wants to change for another model, or another merchandise of a different price, he must return the item and make another order.

Shipping and return costs will only be refunded in the event of a shipping error by www.dourada.es. In case of return for not being satisfied with the product (right of withdrawal according to Law 3/2014, of March 27), the original shipping costs of the order you received will not be reimbursed to the customer and the same must take charge of the costs return shipping. The client/customer will have 14 calendar days to return the product(s) to DOURADA through the carrier of their choice, in the case of chosen a Post Office service, it must be certified as registered package, so that the money of the product(s). In case of lost or damage during the return/transport, the cost will be on charge of the client/customer.

We do not accept returns or exchanges postage without prior acceptance by DOURADA. Returns of defective, used, washed, or damaged packaging will not be accepted. The customer must include in the package a document indicating: the name of the order holder, the return number sent by DOURADA at the time of the return communication and a copy of the invoice ticket referring to the purchase.

Once the product is received by DOURADA, the condition of the item will be checked, and then the order amount will be returned according to the payment method chosen by the customer at the time of payment. The return of these amounts will be made within a maximum period of 30 days from the return of the product to the company but always within the period of its arrival at DOURADA.

In the event all that said return and changes, for any of those reasons described in the Return Conditions described above, DOURADA will inform the customer through an email any further details.

INTELLECTUAL AND INDUSTRIAL PROPERTY

DOURADA has all rights to the content of design, photos, videos, texts, logos, brand and trade names on the Web www.dourada.es. These rights expressly prohibit the adaptation, total or partial reproduction of any textual or graphic content, as well as the industrial property of any of the products on the website. Failure to comply with the regulations set forth will be considered an infringement of intellectual and industrial rights under current regulations in Spain. For any reproduction or resale, the interested party must contact us by email and request written authorization.

The rights of reproduction of any social networks content requires mandatory mentioning of the DOURADA company and as long as no negative or harmful reference is made to the DOURADA company.

Any reference considered negative or harmful by the company will be considered unauthorized and the intellectual and industrial property law will apply. DOURADA reserves the right to add and remove content at the appropriate time, as well as deny and block access for any user who misuses them.

The information offered on the website www.dourada.es has the purpose to orient the client and the company assumes no responsibility in the accuracy of interpreting this information. All questions can be resolved through the email art@dourada.es before the purchase of any product.

ACCESSIBILITY

Since the website www.dourada.es is linked to an online sales platform (Shopify), it is not possible to guarantee that access will be free of interruptions, viruses or browsing errors. The company is not responsible for damages and computer alterations that navigation may cause in users' computers, tablets or mobiles.

LIABILITY OF CONTENT

DOURADA is not responsible for the control of access to content by minors, such responsibility is expressly transferred to the parents or legal responsible for controlling their browsing through the Internet.
